These Terms and Conditions (“Terms”) govern your access to and use of BeMyGirlfriend.app (the “Platform”) and all related services provided by Amazia Technologies Pvt Ltd (OPC) (“Company,” “we,” “us,” or “our”). By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Eligibility and Age Requirement

By creating an account or using our services, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement. We reserve the right to verify your age and terminate accounts of users found to be underage.

2. Nature of Services

BeMyGirlfriend.app provides AI-powered virtual companion services including:

• •AI-generated images and multimedia content
• •Voice messaging features
• •Premium subscription features

All services are digital in nature. No physical products are shipped.

3. Account Registration

To access certain features, you must create an account. You agree to:

1. Provide accurate, current, and complete registration information
2. Maintain the security of your password and account
3. Immediately notify us of any unauthorized account access
4. Accept responsibility for all activities under your account

4. Acceptable Use Policy

You agree NOT to use our services to:

• •Generate, share, or request content involving minors in any inappropriate context
• •Create content that promotes violence, harassment, or illegal activities
• •Impersonate real individuals, celebrities, or public figures
• •Infringe upon intellectual property rights or copyrights
• •Attempt to reverse-engineer, hack, or exploit the platform
• •Use automated systems or bots without authorization
• •Violate any applicable local, national, or international laws

Violation of these policies may result in immediate account suspension or termination without refund.

5. Subscriptions and Payments

5.1 Subscription Plans

We offer various subscription plans (monthly, quarterly, yearly). Details of features and pricing are available on our platform.

5.2 Payment Processing

All payments are processed securely through RBI-licensed and PCI-DSS compliant payment gateways. We accept major credit/debit cards and other payment methods as displayed. By making a purchase, you authorize us to charge the applicable fees.

5.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. You will receive a reminder before each renewal.

5.4 Discreet Billing

For your privacy, transactions will appear under a neutral merchant descriptor on your bank/card statements.

5.5 Payment Processors & Merchant of Record

We use multiple trusted, PCI-DSS compliant payment processors to handle transactions securely:

• •PayPal – PayPal wallet and card payments
• •Razorpay – India-based payments (UPI, cards, net banking)
• •Cashfree – India-based payment solutions

Depending on your location and payment method, our designated Merchant of Record (e.g., Creem.io) acts as the legal seller of record for your transaction. The Merchant of Record is responsible for processing your payment, issuing invoices, and handling payment-related compliance. We do not store your full card number or CVV directly on our servers.

5.6 Refunds

Refund eligibility is governed by the policies of the payment provider or Merchant of Record processing your transaction. Please review our Refund Policy for detailed information on refund requests, eligibility criteria, and processing timelines.

6. Intellectual Property Rights

All content, software, graphics, text, logos, and trademarks on this Platform are the exclusive property of Amazia Technologies or its licensors. You may not copy, reproduce, distribute, modify, or create derivative works without our prior written consent.

AI-generated content created through our platform is subject to our content licensing terms. You retain personal use rights to content you create but may not use it for competing services.

7. Disclaimer of Warranties

Our services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied. We do not guarantee:

• •Uninterrupted or error-free service
• •Accuracy or reliability of AI-generated content
• •Suitability for any particular purpose

AI companions are fictional entities and should not be considered substitutes for professional advice, therapy, or real human relationships.

8. Limitation of Liability

To the maximum extent permitted by law, Amazia Technologies Pvt Ltd (OPC) shall not be liable for:

• •Any indirect, incidental, special, consequential, or punitive damages
• •Loss of profits, data, or business opportunities
• •Damages arising from your use or inability to use our services
• •Third-party actions or content

Our total liability for any claims shall not exceed the amount you paid for services in the 3 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Amazia Technologies Pvt Ltd (OPC), its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or our content policies. Upon termination, your right to access the Platform ceases immediately. You may also delete your account at any time through your account settings.

11. Modifications to Terms

We may update these Terms at any time. Significant changes will be communicated via email or platform notification. Continued use after changes constitutes acceptance of the revised Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Gurgaon, Haryana, India.

13. Dispute Resolution

Before pursuing legal action, you agree to attempt to resolve disputes through good-faith negotiation by contacting us at support@bemygirlfriend.app.

14. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
